These Terms of Service ("Terms") constitute a legally binding agreement between you and tinysamples governing your access to and use of the tinysamples sample tracking platform at tinysamples.com (the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. The Service

1.1 Description

tinysamples is a web-based SaaS application that allows research teams to register and track samples, log laboratory activities, organise samples into projects and batches, and search and export sample history.

1.2 Service Availability

We aim for 99.9% monthly uptime. The Service is provided "as is" without guarantee of uninterrupted availability.

1.3 Modifications

We reserve the right to modify or discontinue any part of the Service with at least 30 days notice for material changes.

2. Accounts

You must create an account with a valid email address or Google OAuth. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. You must be at least 16 years old to use the Service.

3. Acceptable Use

You may use tinysamples for legitimate research, scientific, educational, or commercial laboratory work. You agree not to attempt unauthorised access, reverse-engineer the Service, introduce malware, or attempt to circumvent billing systems. Violations may result in immediate account termination.

4. Plans, Billing, and Payment

Paid plans (Pro, Team) are billed in advance monthly or annually via Stripe. Subscriptions auto-renew unless cancelled. Pro and Team plans include a 14-day free trial — no credit card required. Monthly subscriptions: no refunds for partial months. Annual subscriptions: pro-rated refunds available within 30 days of renewal. Price increases are communicated at least 30 days in advance.

5. Your Data

You retain full ownership of all data you upload or create in tinysamples. You grant us a limited licence to store and process your data solely to provide the Service. You may export your data to CSV at any time. Upon account deletion, your data is retained for 30 days then permanently deleted.

6. Intellectual Property

The Service and all associated IP is owned by tinysamples. You may not copy, reverse-engineer, or create derivative works based on the Service. Feedback you submit may be used by us without obligation.

7. Confidentiality

We treat your data as confidential and will not disclose it to third parties except as described in our Privacy Policy.

8. Third-Party Services

The Service integrates with third-party services (Google OAuth, Stripe). Your use of those services is governed by their own terms.

9. Suspension and Termination

You may cancel your account at any time from Profile settings. We may suspend or terminate accounts for Terms violations, payment failures, or legal requirements. Your data is retained for 30 days after termination before deletion.

10. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

tinysamples is a productivity tool, not a certified LIMS for regulated environments (e.g. FDA 21 CFR Part 11) unless agreed in a separate enterprise contract.

12. Indemnification

You agree to indemnify tinysamples from claims arising from your use of the Service in violation of these Terms or applicable law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules. Class action waivers apply. EU/UK users may have additional rights under local consumer protection law.

14. General Provisions

These Terms constitute the entire agreement between you and tinysamples. If any provision is held invalid, the remaining provisions remain in force. We may assign our rights in connection with a merger or acquisition.

15. Changes to These Terms

Material changes will be communicated by email at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
